Let’s Talk About LIBEL!

Hello All:

Looks like my next challenge will be a libel suit :) I say, “Bring it on Town of Springerville, former Mayor Dyson, Chief of Police West, etc., etc.” Just think of all the dirty little secrets that will inadvertently be exposed in a libel suit, or, all of the skeletons that will be dragged out of your closets. The thought of it is exhilarating! All I have to do is sit back and watch them bury themselves!
Here’s the skinny on “Slander/Libel:”
“Slander and Libel are false or malicious claims that may harm someone’s reputation.” There are five key elements to satisfy in a Libel Suit:

Elements of a Libel Case (It requires ALL five elements to succeed!)

Under United States law, libel generally requires five key elements.

1. The plaintiff must prove that the information was published.
2. The defendant was directly or indirectly identified.
3. The remarks were defamatory towards the plaintiff’s reputation,
4. The published information is false,
5. And that the defendant is at fault.

In law, defamation (also called calumny, libel, slander, and vilification) is the communication of a statement that makes a claim, expressly stated or implied to be factual, that may give an individual, business, product, group, government or nation a negative image. It is often, but not always, a requirement that this claim be false, and, or alternatively, that the publication is made to someone other than the person defamed.

Defenses:
Even if a statement is derogatory, there are circumstances in which such statements are permissible in law.
Truth:
In many legal systems, adverse public statements about legal citizens presented as fact must be proven false to be defamatory or slanderous/libel.
In order to win damages in a libel case, the plaintiff must first show that the statements were “statements of fact or mixed statements of opinion and fact” and second that these statements were false.
It is also necessary in these cases to show that there is a well-founded public interest in the specific information being widely known, and this may be the case even for public figures. Public interest is generally not “that which the public is interested in”, but rather “that which is in the interest of the public.”

Defamation law in the United States is much less plaintiff-friendly than its counterparts in European and the Commonwealth countries. In the United States, a comprehensive discussion of what is and is not libel or slander is difficult, because the definition differs between different states, and under federal law. Some states codify what constitutes slander and libel together into the same set of laws. Criminal libel is rare or nonexistent, depending on the state. Defenses to libel that can result in dismissal before trial include the statement being one of opinion rather than fact or being “fair comment and criticism”. Truth is always a defense.

Be Careful What you Wish For!

Hello All:

Awhile ago I received the hateful comment I have posted below; (Saturday, August 30, 2008 10:33 AM). The wording is most interesting because it’s a perfect case of “Be careful what you wish for.” In this person’s case, someone did get exactly what was coming to them, it just wasn’t me.

“I Have NO Memory of THAT”

Hello All:

Remember the post about my so-called “Interview” with the State Police? The detective that did that “Interview” has NO memory of doing that interview, bringing my book with him, or any other information about that “Interview.” Telling him he was heard on an audio tape conducting the “Interview” didn’t jog his memory the least little bit either.

I can hear the scrambling, can you?

Medical Breakthrough!!

Hello All:

I have some very depressing news: A new breakthrough in mental illness has just been revealed:

“Telling the truth is the hallmark behavior of paranoia!”

Sorry to be the one to break this most depressing news; imagine my surprise when I first learned that telling the truth is a mental illness.

I couldn’t find this information in the DSM-IV Codes (Diagnostic and Statistical Manual of Mental Disorders, 4th Edition), however, a former gov’t official has said it, so, it has to be true, right?

I will take “Paranoia” as my assigned mental illness, compared to some other choices; delusions and/or pathalogical lying.

Grading Papers

Hello All:

Here’s a new one: A so-called attorney that has no case, and nowhere to go with what’s in front of her, that instead of defending her clients she grades the papers I file with the court. I think she may be practicing for an interview with the Harvard Law School. She never addresses the issues of this lawsuit, only the perfection, or lack thereof, of my pleadings. Since I used to teach, I find her ‘grading’ style most amusing and infantile, to say the least. I think she also street brawls so good ONLY on paper, and that an actual conversation with someone is way out of her league. Although, that seems to be the case with most all attorneys.

No matter what tricks and diversions she uses to delay this, I WILL have my day in court, the Constitution guarantees that. Hmmm…wonder if she’s heard of the Constitution?
